Terms of Service

1. About Lunchd

Lunchd is a social platform designed to help people discover, create, join, and coordinate in-person lunch meetups.

Lunchd is owned and operated by APT53 Ltd., a company registered in the United Kingdom. References to "Lunchd", "we", "us", and "our" mean APT53 Ltd.

2. Eligibility

You must be at least 18 years old to use Lunchd.

By using Lunchd, you confirm that:

• you are at least 18;
• you are legally capable of entering into a binding agreement; and
• you will comply with these Terms and all applicable laws.

We may suspend or terminate access if we reasonably believe you do not meet these requirements.

3. Beta Status

Lunchd is currently in beta.

This means that features, availability, design, and functionality may change at any time. Some parts of the service may be incomplete, unavailable, or removed without notice. You acknowledge that beta services may contain bugs or interruptions and may not always perform as expected.

4. Your Account

To use certain features, you may need to create an account.

You are responsible for:

• providing accurate and up-to-date information;
• keeping your login credentials secure;
• all activity that occurs under your account; and
• promptly notifying us if you believe your account has been compromised.

You must not:

• create an account using false or misleading information;
• impersonate another person;
• share your account with others; or
• access another user's account without permission.

5. Acceptable Use

You agree to use Lunchd lawfully, respectfully, and only for its intended purpose.

You must not:

• harass, threaten, intimidate, stalk, or abuse other users;
• engage in hateful, discriminatory, sexually inappropriate, violent, or exploitative conduct;
• post or send content that is unlawful, defamatory, obscene, fraudulent, or misleading;
• use Lunchd to spam, scam, advertise without permission, or collect other users' data without consent;
• interfere with, disrupt, or attempt to gain unauthorized access to Lunchd or related systems;
• use bots, scrapers, or automated methods to access or extract data from Lunchd except where we have expressly allowed it; or
• use Lunchd in any way that could harm other users, third parties, or the integrity of the service.

6. Community Safety and In-Person Meetups

Lunchd helps users coordinate in-person lunches, but we do not supervise or control users, venues, or in-person interactions.

You are responsible for your own decisions, conduct, and safety when using Lunchd and when meeting other users offline.

You understand and agree that:

• other users are solely responsible for their own conduct;
• venues, restaurants, and other locations are operated by third parties;
• we do not guarantee the behaviour, identity, intentions, or reliability of any user or venue; and
• you should use your own judgment and take reasonable precautions when attending any meetup.

If you experience unsafe behaviour or believe a user has violated these Terms, you should stop engaging with that user and contact us.

Lunchd is not an emergency service and should not be used to seek emergency help.

7. Lunches, Groups, and App Features

Lunchd may allow users to create, discover, join, leave, and coordinate lunches and groups, including through profile features, messaging, notifications, and location-based discovery.

We may add, remove, limit, or change features at any time, especially during beta.

We do not guarantee:

• that any lunch or group will reach minimum attendance;
• that any user will join or attend a lunch;
• that lunches will occur exactly as scheduled;
• that messages or notifications will always be delivered immediately or at all; or
• that any specific venue, location, or recommendation will always be available.

If we introduce paid features, subscriptions, or promotions in the future, we may present additional terms at that time.

8. Location and Notifications

Some Lunchd features may depend on location data or notifications.

If you choose to enable location access, Lunchd may use approximate or coarse location data to show nearby lunches, improve discovery, and estimate travel time.

If you choose to enable notifications, Lunchd may send service-related alerts such as lunch reminders, group activity updates, and chat notifications.

You can manage these permissions in your device settings, but some features may not function properly if you disable them.

9. User Content

You may submit content to Lunchd, including profile information, profile photos, messages, feedback, ratings, reports, and other material you choose to upload or share ("User Content").

You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and use that User Content as needed to:

• operate and provide Lunchd;
• moderate, review, and enforce these Terms;
• maintain safety and service integrity;
• troubleshoot, improve, and develop the service; and
• comply with legal obligations.

This license lasts only for as long as necessary for those purposes.

You are solely responsible for the User Content you submit. You confirm that:

• you have the rights needed to submit it;
• it does not infringe the rights of others; and
• it complies with these Terms and applicable law.

We may remove, review, restrict, or refuse User Content if we reasonably believe it breaches these Terms, creates risk, or harms users or Lunchd.

10. Feedback

If you send us feedback, ideas, suggestions, or product comments, you agree that we may use them without restriction or compensation to you.

11. Suspension, Termination, and Account Deletion

We may suspend, restrict, or terminate your access to Lunchd if:

• you breach these Terms;
• we believe your use creates risk for users, third parties, or Lunchd;
• we are investigating suspected misuse, abuse, fraud, or unlawful activity; or
• we decide to change, pause, or discontinue the service.

You may stop using Lunchd at any time.

If you delete your account through the app, your account will be closed and your associated personal data will be handled in line with our Privacy Policy.

Sections of these Terms that by their nature should survive termination will continue to apply after termination, including sections relating to safety, intellectual property, disclaimers, liability, and governing law.

12. Intellectual Property

Lunchd and its branding, software, design, text, graphics, logos, and other content made available by us are owned by or licensed to APT53 Ltd. and are protected by intellectual property laws.

Except as expressly allowed by these Terms, you must not:

• copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any part of Lunchd; or
• reverse engineer, decompile, or attempt to extract source code from Lunchd, except where applicable law does not allow that restriction.

13. Privacy

Your use of Lunchd is also governed by our Privacy Policy, which explains how we collect, use, store, and delete personal data.

14. Disclaimers

To the fullest extent permitted by law, Lunchd is provided on an "as is" and "as available" basis.

We do not guarantee that Lunchd will be uninterrupted, error-free, secure, or available at all times. We also do not guarantee that:

• the service will meet all of your expectations;
• any lunch, meetup, or connection will occur successfully;
• any content, venue information, location result, or recommendation will always be accurate or complete; or
• the conduct of users or third parties will meet your expectations.

Nothing in these Terms excludes or limits any rights you may have under applicable consumer law that cannot lawfully be excluded.

15. Limitation of Liability

To the fullest extent permitted by law, APT53 Ltd. will not be liable for any indirect, incidental, special, consequential, or punitive loss or damage, or for any loss of profits, revenue, business, goodwill, data, or opportunity arising out of or in connection with your use of Lunchd.

We are also not responsible for:

• the acts, omissions, or conduct of other users;
• third-party venues, restaurants, or locations;
• personal injury, loss, or damage arising from in-person interactions arranged through Lunchd; or
• service interruptions, bugs, or beta-related issues.

If we are liable to you for any claim arising out of these Terms or Lunchd, our total liability will be limited to the greater of:

• the amount you paid to use Lunchd in the 12 months before the claim arose; or
• £100.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes to the service, our practices, or legal requirements.

If we make changes, we will update the "Last Updated" date above. Where appropriate, we may also provide additional notice. Your continued use of Lunchd after updated Terms take effect means you accept the revised Terms.

17. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer, you may also benefit from any mandatory protections of the laws of the country in the United Kingdom where you live.

Any dispute or claim arising from or related to these Terms or Lunchd will be subject to the jurisdiction of the courts of England and Wales, unless applicable law gives you the right to bring a claim in another UK court with jurisdiction over your place of residence.
