These Terms of Service (“Terms”) govern your use of the Lunchd website, mobile application and related services. By accessing or using Lunchd, you agree to these Terms and our Privacy Policy.
1. About Lunchd
Lunchd is a social platform designed to help people discover, create, join and coordinate in-person lunch meetups.
Lunchd is owned and operated by APT53 Ltd, company number 16566206, registered in England and Wales. Our registered office is 86–90 Paul Street, London, England, EC2A 4NE. References to “Lunchd”, “we”, “us” and “our” mean APT53 Ltd.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use Lunchd. By using Lunchd, you confirm that you meet these requirements and will comply with these Terms and applicable law. We may suspend or terminate access if we reasonably believe you do not meet them.
3. Beta status
Lunchd is currently in beta. Features, availability, design and functionality may change. Some parts of the service may be incomplete, unavailable or removed without notice, and beta services may contain bugs or interruptions.
4. Your account
You are responsible for providing accurate information, keeping your login credentials secure, activity under your account and promptly notifying us if you believe it has been compromised.
You must not create an account using false or misleading information, impersonate another person, share your account, or access another user's account without permission.
5. Acceptable use
You agree to use Lunchd lawfully, respectfully and only for its intended purpose. You must not:
- harass, threaten, intimidate, stalk or abuse other users;
- engage in hateful, discriminatory, sexually inappropriate, violent or exploitative conduct;
- post or send content that is unlawful, defamatory, obscene, fraudulent or misleading;
- use Lunchd to spam, scam, advertise without permission or collect other users' data without consent;
- interfere with, disrupt or attempt to gain unauthorised access to Lunchd or related systems;
- use bots, scrapers or automated methods to access or extract data unless expressly allowed; or
- use Lunchd in a way that could harm users, third parties or the integrity of the service.
6. Community safety and in-person meetups
Lunchd helps users coordinate in-person lunches, but we do not supervise or control users, venues or in-person interactions. You are responsible for your own decisions, conduct and safety.
We do not guarantee the behaviour, identity, intentions or reliability of any user or venue. Use your own judgement and take reasonable precautions. If you experience unsafe behaviour, stop engaging with that user and report it to us. Lunchd is not an emergency service.
7. Lunches, groups and app features
Lunchd may allow users to create, discover, join, leave and coordinate lunches and groups through profiles, messaging, notifications and location-based discovery. We may add, remove, limit or change features, especially during beta.
We do not guarantee that a lunch will reach minimum attendance, that a user will join or attend, that lunches will occur exactly as scheduled, that messages or notifications will always be delivered, or that a particular venue, location or recommendation will remain available.
If we introduce paid features, subscriptions or promotions, we may present additional terms at that time.
8. Location and notifications
If you choose to enable location access, Lunchd requests location coordinates using your device's balanced-accuracy setting, typically accurate to around 100 metres. We use this information to show nearby lunches and venues, improve discovery and estimate travel time. We do not request background location. Your most recent stored location replaces the previous one.
If you enable notifications, Lunchd may send lunch reminders, group-activity updates, chat notifications and important service notices. You can manage these permissions in your device settings, but related features may not function properly if you disable them.
9. User content
You may submit profile information, profile photos, messages, feedback, ratings, reports and other material (“User Content”). You retain ownership of your User Content, but grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display and use it as needed to operate Lunchd, moderate and enforce these Terms, maintain safety and service integrity, troubleshoot and improve the service, and comply with legal obligations.
If you delete your account, messages you previously sent in lunch group chats may remain visible to the other members after your profile and account link have been removed. Your first name may remain in a quoted reply preview created by another member because that preview stores a separate snapshot of the replied-to sender's name. You grant us the limited licence needed to continue displaying those messages and quoted previews as part of the relevant conversation. Safety reports may also be retained without an account link where necessary to protect members, investigate misconduct, comply with law or handle legal claims, as explained in our Privacy Policy.
You are responsible for your User Content and confirm that you have the rights needed to submit it, it does not infringe the rights of others, and it complies with these Terms. We may remove, review, restrict or refuse content that we reasonably believe breaches these Terms, creates risk or harms users or Lunchd.
10. Feedback
If you send us feedback, ideas, suggestions or product comments, you agree that we may use them without restriction or compensation to you.
11. Suspension, termination and account deletion
We may suspend, restrict or terminate access if you breach these Terms, your use creates risk, we are investigating suspected misuse or unlawful activity, or we change, pause or discontinue the service. You may stop using Lunchd at any time.
If you delete your account through the app, your account, profile, profile photo, stored location, notification preferences, push tokens and lunch memberships will be deleted as described in our Privacy Policy. Messages you sent in lunch group chats may remain visible without your profile attached, your first name may remain in quoted reply previews created by other members, and safety records may be retained without an account link where necessary. These limited exceptions do not affect your rights under data protection law.
Provisions that by their nature should survive termination will continue to apply, including provisions relating to safety, intellectual property, disclaimers, liability and governing law.
12. Intellectual property
Lunchd and its branding, software, design, text, graphics, logos and other content made available by us are owned by or licensed to APT53 Ltd and protected by intellectual-property laws.
Except as expressly allowed, you must not copy, reproduce, distribute, modify, create derivative works from, publicly display or exploit any part of Lunchd, or reverse engineer, decompile or attempt to extract source code, except where applicable law does not allow that restriction.
13. Privacy
Your use of Lunchd is governed by our Privacy Policy, which explains how we collect, use, store and delete personal data.
14. Disclaimers
To the fullest extent permitted by law, Lunchd is provided on an “as is” and “as available” basis. We do not guarantee that it will be uninterrupted, error-free, secure or always available, that a lunch or connection will occur successfully, that content or location information will always be accurate, or that the conduct of users or third parties will meet your expectations.
Nothing in these Terms excludes or limits consumer rights that cannot lawfully be excluded.
15. Limitation of liability
To the fullest extent permitted by law, APT53 Ltd will not be liable for indirect, incidental, special or consequential loss, or loss of profits, revenue, business, goodwill, data or opportunity arising from your use of Lunchd.
We are not responsible for the acts or conduct of other users; third-party venues or locations; personal injury, loss or damage arising from in-person interactions arranged through Lunchd; or service interruptions, bugs or beta-related issues.
If we are liable for a claim arising from these Terms or Lunchd, our total liability will be limited to the greater of the amount you paid to use Lunchd in the 12 months before the claim arose or £100.
Nothing excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited.
16. Changes to these Terms
We may update these Terms to reflect changes to the service, our practices or legal requirements. We will post the current version here, update the “Last updated” date and provide additional notice where appropriate. Your continued use after updated Terms take effect means you accept them.
17. Governing law
These Terms are governed by the laws of England and Wales. If you are a consumer, you may also benefit from mandatory protections of the laws of the UK country where you live. Disputes will be subject to the courts of England and Wales unless applicable law gives you the right to bring a claim in another UK court with jurisdiction over where you live.
